1. Acceptance of Terms

By accessing or using Captsr ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

2. Description of Service

Captsr is a neutral image captioning tool that allows users to upload images, add text captions, and generate shareable images. The Service is provided "as is" for personal, non-commercial use.

Captsr is a passive tool only. We provide image processing functionality but do not control, direct, or influence what content users choose to upload or create. We do not pre-screen, monitor, or review user-uploaded content before or during processing. The Service functions as automated software that processes user inputs without human review.

3. Age Requirement

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age. We do not knowingly provide services to minors.

4. User Responsibilities & Liability

You are solely and entirely responsible for:

  • All content you upload, create, or share using the Service
  • Ensuring you have the legal right to use any images you upload
  • Verifying that your content complies with all applicable laws in your jurisdiction
  • Any and all consequences arising from your use of the Service
  • Any claims, damages, or legal action resulting from content you create

You acknowledge that Captsr has no ability to verify the legality, ownership, or appropriateness of content you upload. You assume full legal responsibility for all content you process through the Service.

5. Prohibited Content & Uses

Zero Tolerance Policy: The following content is strictly prohibited and will result in immediate termination and reporting to appropriate law enforcement authorities:

  • Child Sexual Abuse Material (CSAM): Any sexual or exploitative content involving minors is absolutely prohibited. We maintain a zero-tolerance policy and will report all such content to appropriate law enforcement authorities.
  • Child exploitation: Any content that sexualizes, exploits, or endangers minors in any way
  • Non-consensual intimate imagery: Intimate or sexual images shared without the subject's consent

You also agree NOT to use the Service to:

  • Create, upload, or distribute any other illegal content
  • Produce content depicting violence, torture, or abuse
  • Infringe on intellectual property rights of others
  • Create defamatory, harassing, or threatening content
  • Distribute malware or harmful code
  • Impersonate others or create misleading content
  • Violate the privacy or rights of any third party
  • Engage in any activity that disrupts or interferes with the Service
  • Use automated systems to access the Service without permission

6. Content Ownership

You retain ownership of any images you upload. By using the Service, you grant us a limited license to process your images solely for the purpose of providing the Service. We do not claim ownership of your content.

7. No Monitoring or Pre-Screening

Captsr does not and cannot monitor, pre-screen, review, or filter user-uploaded content. The Service operates as automated software without human oversight of individual uploads. We have no knowledge of the content being processed until and unless it is reported to us or discovered through other means.

By using this Service, you acknowledge that we are a neutral technology provider and not a publisher or curator of user content.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE MAKE NO REPRESENTATIONS REGARDING THE LEGALITY OR APPROPRIATENESS OF USER-GENERATED CONTENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAPTSR AND ITS OPERATORS, OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, consequential, or punitive damages
  • Any content uploaded, created, or distributed by users
  • Any illegal, harmful, or objectionable content processed through the Service
  • Any third-party claims arising from user-generated content
  • Any damages resulting from unauthorized access to or use of our servers
  • Any loss of data, profits, or business opportunities

Captsr functions solely as a neutral image processing tool. We do not control, endorse, or take responsibility for any content created by users. The entire risk arising from your use of the Service remains solely with you.

10. Indemnification

You agree to fully indemnify, defend, and hold harmless Captsr, its operators, owners, employees, agents, and affiliates from and against any and all claims, demands, actions, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising from or relating to:

  • Your use or misuse of the Service
  • Any content you upload, create, or distribute using the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
  • Any claim that your content caused damage to a third party

This indemnification obligation will survive the termination of your use of the Service and these Terms.

11. Cooperation with Law Enforcement

We will cooperate fully with law enforcement authorities investigating illegal activity. This may include disclosing user information, IP addresses, upload records, and any content associated with your use of the Service, without prior notice to you, when required by law or when we believe in good faith that such disclosure is necessary.

12. Content Removal & Termination

We reserve the right to remove any content and immediately terminate access to any user, without prior notice and at our sole discretion. No refunds or compensation will be provided for terminated accounts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Modifications

We may modify these Terms at any time without prior notice. Continued use of the Service after changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

15. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved in the appropriate jurisdiction. You agree to submit to the personal jurisdiction of the courts in that jurisdiction.
